SESSION TITLE:
May the Force Majeure Be With You
AKA: Are you ready for the next disaster!!!
Printable Version

Description:
9/11, Katrina, SARS, H1N1 (Bird Flu), recession, and inflation. We live in turbulent times, natural disasters, manmade catastrophes, and economic turndowns.  The old saying “an once of prevention is worth a pound of cure”, has never been truer. Have you learned to expect the unexpected or prepare for the unexpected? Do you know what to do? Where to start?

To avoid the unappreciated consequences of entering into a liability-laden contract unintentionally, exposition and meeting industry professionals must be forward thinking- “clairvoyant” so to speak. By drafting or modifying key contractual provisions, you can substantially reduce your organization’s exposure to unnecessary liability and risks. However, it takes knowledge combined with thoughtful and direct communication with the facilities and vendors to accomplish this before and after disaster strikes.

Participants will be provided with a greater understanding of the important legal issues that need to be reviewed, modified or included in today’s exposition industry contracts. Special focus will be paid to the areas of cancellation, Force Majeure/Acts of God, excused non-performance attrition, and security concerns.

Learner Outcomes:
This session will enable participants to:

  • More effectively and efficiently negotiate facility and service provider contracts.
  • Develop a greater awareness of your contractual rights and obligations in order to avoid potential liability pitfalls and disputes in advance.
  • Better understand the importance of cancellation, Force Majeure, attrition provisions, as well as the true meaning some of those often overlooked "Boiler Plate Clauses".
